What relationship must the reader understand?

Record who commissioned the material, who benefits from it and what the publisher or creator receives. Consider payment, products, services, affiliate compensation and other material arrangements. Identify whether the page is paid editorial, an influencer collaboration, an obviously commercial company profile or a different format. The correct review depends on those facts.

The EU Unfair Commercial Practices Directive addresses undisclosed paid promotion in editorial media content in Annex I point 11. This is a specific consumer-protection provision. It does not turn one preferred label into a complete compliance solution for every jurisdiction or sector.

What does UOKiK recommend for Polish influencer content?

For the influencer situations it covers, UOKiK’s current guidance calls for a clear commercial identification, the promoted brand and legible presentation. It recommends using the platform’s disclosure feature together with the creator’s own clear label. Its examples distinguish paid collaborations, barter, affiliate links, gifts and clearly commercial shop profiles.

Apply that guidance within its scope. A Polish-language reader should immediately understand the chosen wording. An illustrative label such as “Materiał reklamowy. Reklama marki Cedar Works” should describe a real commercial relationship; it is not a universal legal formula. Assess the platform, format and actual arrangement with the responsible reviewer.

Where should the disclosure appear?

Review the page as a reader encounters it. Check the top of the article, the mobile layout, social preview and any embedded video or audio. Ensure the commercial nature remains understandable without inspecting source code or opening a separate policy page. If the content is shortened or syndicated, verify that the necessary disclosure travels with the new presentation.

Treat a structured field as supporting metadata. A machine-readable marker does not replace a visible disclosure or guarantee that an AI answer repeats the label. Test whether the published page itself remains clear and accessible before testing any downstream response.

What else needs an independent check?

Advertising disclosure and factual substantiation are separate tasks. A clearly labeled advertorial can still contain an unsupported comparison. Check material product and competitor claims against evidence and, where relevant, the EU comparative-advertising framework.

Likewise, an AI risk register, a statement about hosting location or synthetic personas does not establish privacy compliance or satisfy every AI-related legal requirement. Describe only the actual, verified processing arrangements and obtain the review appropriate to the activity. Avoid inserting standard-sounding contractual assurances without evidence.

How should you monitor the publication?

Save the reviewed page and record any later edits, placement changes or syndication. If an observed AI answer omits the sponsorship context, log that as a downstream observation and investigate the specific output. Keep the source disclosure correct, but do not promise that every external system will preserve it or that a successful test guarantees future behavior.
